1. General Terms

By accessing or using OnboardJS or any related services (collectively, the "Service"), you agree to be bound by these Terms & Conditions ("Terms"). These Terms govern your access to and use of the OnboardJS website, API, and analytics platform (the "OnboardJS Cloud"), as well as any communications between you and OnboardJS.

OnboardJS is built on the open-source OnboardJS library distributed under the MIT License, and the analytics Service is provided as a hosted SaaS offering operated by the creator and maintainers of OnboardJS ("we", "our", or "us").

We may modify these Terms at any time by posting an updated version on the Service. Continued use of the Service after changes become effective constitutes acceptance of the new Terms.

Under no circumstances shall OnboardJS, its maintainers, contributors, or affiliates be liable for any indirect, incidental, special, or consequential damages (including data loss or revenue loss) arising from the use or inability to use the Service.


2. Accounts

2.1 Account Creation

To access the analytics dashboard or API, you must create an account and provide accurate registration details. You are responsible for maintaining the confidentiality of your login credentials and for all activity conducted through your account.

2.2 Account Termination

You may delete your account at any time via the user interface or by contacting support. We may suspend or terminate access for violations of these Terms or for inactivity.


3. License and Use

You are granted a limited, revocable, non-exclusive, non-transferable license to access and use the OnboardJS Cloud Service. The underlying OnboardJS JavaScript library remains separately governed by its MIT open-source license, which permits use and modification with attribution.

These Terms apply only to the hosted analytics portion and not the open-source codebase itself.


4. Restrictions

You agree not to:

  • Rent, lease, sublicense, or commercialize the Service or any of its components;
  • Decompile or reverse-engineer any server-side component of the Service;
  • Attempt to access non-public areas or interfere with system integrity;
  • Use the Service for unlawful purposes or to integrate data collected in violation of applicable privacy laws.

5. Subscription Terms & Fees

If you subscribe to a paid plan, billing terms are as set forth in the pricing page of the Service.

  • Monthly Plans renew automatically each month unless canceled prior to the next billing cycle.
  • Annual Plans renew yearly unless canceled at least 30 days before renewal.

Fees are non-refundable except where required by law. We reserve the right to adjust pricing and plan features with prior notice via email or in-app notification.


6. Intellectual Property

Except for user-generated content and open-source components licensed under their respective terms, all rights, titles, and interests in the OnboardJS brand, analytics platform, and its code are owned by OnboardJS or its contributors.

You may not use the OnboardJS name, logo, or other branding without prior written permission except for legitimate attribution related to the MIT-licensed library.


7. Data & Privacy

By using the Service, you acknowledge that aggregated and anonymized usage data may be collected to maintain and improve the platform. Personally identifiable information is processed only as necessary to provide the Service and is handled in accordance with our Privacy Policy (published separately).

If you process EU or California user data through OnboardJS, future versions of these Terms will include GDPR/CCPA data processing clauses once OnboardJS formally registers as a legal entity.


8. Limitations of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND.

TO THE FULLEST EXTENT PERMITTED BY LAW, ONBOARDJS AND ITS CONTRIBUTORS DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

In no event shall OnboardJS or its maintainers be liable for indirect or consequential damages, or for any loss of data, business, or revenue. Liability shall not exceed the total amount paid by you (if any) for the use of the Service in the preceding three months.


9. Termination

These Terms remain in effect until terminated. We may suspend or discontinue your access at any time, with or without notice, for any reason, including suspected misuse or service disruption. Upon termination, your access ceases immediately, and any data stored in your account may be deleted.


10. Modifications & Updates

We may modify, suspend, or discontinue any part of the Service, temporarily or permanently, with prior notice when practical. Updates may alter or remove certain features. Continued use after updates constitutes acceptance of modifications.


11. Indemnification

You agree to indemnify and hold harmless OnboardJS and its contributors from any claims, losses, damages, or liabilities arising from your use of the Service, violation of these Terms, or infringement of third-party rights.


12. Separability & Entire Agreement

If any provision of these Terms is deemed invalid, the remaining provisions shall remain in full force. These Terms, together with the Privacy Policy, constitute the entire agreement between you and OnboardJS concerning the use of the Service.


13. Governing Law

As OnboardJS is not yet a registered entity, these Terms are governed by general principles of contract law applicable in the jurisdiction of the creator until formal incorporation.
